RIGHT OF WITHDRAWAL FROM A CONTRACT

1. The Customer (Consumer) may withdraw from a contract for any reason in 14 days, where the withdrawal period begins:

a) for a contract in the performance of which Elan Beauty sp. z o. o. delivers an item, being obliged to transfer its ownership - from taking possession of the item by the Customer (Consumer) or a third party other than the carrier designated by the consumer, and in the case of a contract which:

- includes a lot of things which are delivered individually, in sections or in parts - from the reception of the last thing, section or part,

- consists in regular delivery of goods for a fixed period of time - from taking possession of the first item;

2) for other contracts – from the day of their conclusion.

2. The Customer (Consumer) may withdraw from a contract by submitting a statement of withdrawal to the address: Elan Beauty Sp. z o. o., Al. Jana Pawla II, nr 22, Floor 4, Office 3, 00-133, Warsaw. In order to keep the withdrawal period, you simply need to send the statement before the term for withdrawal from the contract expires. The statement may be submitted with the model form that is an attachment to these Regulations.

3. In case of withdrawal from a contract the Customer (Consumer) is obliged to return purchased goods in 14 days from the day of withdrawal. The Customer (Consumer) bears only the direct costs of the return of goods. The Shop does not accept any shipment sent by postal collection order.

4. Goods shall be returned to the address: Elan Beauty Sp. z o. o., Al. Jana Pawla II, nr 22, F lo o r 4 , Office 3 00-133, Warsaw in 14 days from the day of submission of withdrawal statement.

5. Elan Beauty sp. z o. o. no later than in 14 days from the day of receiving a withdrawal statement shall return the Customer all payments that he made. Return of payments made by Customer is done with the same method as the Customer used to make them, unless the Customer clearly agreed to a different method of return, which does not entail any additional cost to him. The Shop is entitled to withhold the return of payments to the Customer until returned goods have been received by the Shop or until being provided by the Customer with the proof of sending them back, depending on which of these two event occurs first.

6. If the Customer (Consumer) has opted for a more expensive method of delivery than the cheapest standard delivery offered by the Shop, the Shop does not have to reimburse the additional costs for the more expensive method.

7. The Customer (Consumer) shall be liable for lowering of the value of the product if it results from a use that was beyond necessary to check its character, properties and functioning.

8. The return of goods should – as much as it is possible – include all documents attached to it, in particular invoice, if it was used for the Customer (Consumer), also - in the original package.

9. Right of withdrawal from a contract does not apply in the case of subject of the service being:

- a non-prefabricated product, custom-made for a Customer or intended to satisfy a consumer's individual needs,

- a product that is delivered in a sealed package after opening of which a return is impossible due to health safety or sanitary aspects,

- a product that when delivered, by its nature, is inseparably linked to other things,

- in other cases provided for by law.

10. The above rules also apply to a natural person who enters into a distance contract with Elan Beauty sp. z o. o. regarding purchase of Goods in the Shop directly related to his economic activity, where it appears from the content of the contract that it does not have a professional character for that person, arising in particular from the subject of economic activity conducted by him, available on the basis of the provisions on Central Records and Activity Information (example CEIDG). Other Customers that are entrepreneurs, in particular commercial law companies, are not entitled to execute above mentioned rights.
